Environmental Recruitment Agency Limited is a company registered in Scotland under company number SC716390. Environmental Recruitment Agency Limited trades as Enviro Recruit and Wind Talent. Wind Talent is not a separate legal entity; it is a specialist trading brand focused on wind energy, renewable energy and related environmental recruitment.

For the purposes of data protection law, Environmental Recruitment Agency Limited is the data controller for candidate personal data processed through Enviro Recruit, Wind Talent and related recruitment activity.

2. What this notice covers

This Candidate Privacy Notice explains how we collect, use, store and share personal data about candidates, applicants, prospective candidates and work seekers. It applies when you apply for a role, send us your CV, register with us, are contacted by us about a potential role, are identified through LinkedIn, job boards, CV databases, referrals, sourcing tools or other recruitment-related sources, are submitted to a client, or take part in screening, interviews, reference checks or placement processes.

3. Personal data we may collect

  • name, address, email address and telephone number;
  • CV, work history, employment background and career information;
  • job preferences, salary expectations, notice period and availability;
  • location and willingness to travel or work away from home;
  • qualifications, training, certifications, licences, tickets and trade cards;
  • professional registrations and membership details where relevant;
  • right-to-work status information;
  • driving licence status or driving entitlement where relevant to the role;
  • references and referee contact details where provided or agreed;
  • interview notes, screening notes and suitability assessments;
  • assessment results, technical test results or skills evaluation information where relevant;
  • communications with you by email, phone, text, WhatsApp, LinkedIn, Facebook, Instagram or other channels;
  • information from job boards, CV databases, LinkedIn, recruitment platforms, referrals or publicly available sources;
  • information relating to offers, placements, start dates, salary and employment terms;
  • limited equality, diversity, health or adjustment information where required, lawful and relevant to the recruitment process.

For technical, trade, site-based or safety-critical roles, we may ask for evidence of role-critical qualifications, cards, licences, tickets or training records. We will only ask for information that is relevant to the role or recruitment process.

4. How we collect your personal data

  • directly from you when you apply for a job, send us your CV, complete a registration form, speak to us during screening, provide documents, references or other information, or communicate with us;
  • from job boards such as Indeed, CV-Library, Gumtree or similar platforms;
  • from LinkedIn and other professional networking sites;
  • from Facebook, Instagram and other social media platforms where recruitment activity is relevant and lawful;
  • from candidate sourcing tools and recruitment technology platforms;
  • from referrals by candidates, clients or contacts;
  • from public sources where relevant to recruitment;
  • from clients during interview, feedback, offer or placement processes;
  • from referees where you have provided or agreed to reference checks.

5. Why we use your personal data

  • assess your suitability for vacancies;
  • contact you about roles that may be relevant to your experience;
  • register you as a candidate;
  • match your skills, qualifications, location, experience and preferences to client vacancies;
  • discuss vacancies, interviews and recruitment updates with you;
  • arrange interviews and client meetings;
  • submit your CV or candidate profile to clients, but only where appropriate and with your authority for the relevant role;
  • verify role-critical information where relevant, such as qualifications, licences, tickets, trade cards or driving entitlement;
  • manage offers, placements, start dates and recruitment administration;
  • maintain recruitment records;
  • comply with legal, regulatory and contractual obligations;
  • respond to queries, complaints or legal claims;
  • keep you informed about suitable future opportunities, unless you ask us not to.

6. Our lawful basis for using your personal data

6.1 Legitimate interests

We commonly rely on legitimate interests to process candidate data for recruitment purposes. Our legitimate interests include operating a recruitment business, identifying suitable candidates, contacting candidates about relevant roles, assessing suitability, managing client vacancies and keeping appropriate recruitment records. We balance our interests against your rights and freedoms. You can object to processing based on legitimate interests at any time.

6.2 Steps before entering into a contract

Where you apply for a role or ask us to put you forward, we may process your data to take steps at your request before a potential employment contract or engagement with a client.

6.3 Legal obligation

We may process personal data where necessary to comply with legal obligations.

6.4 Consent

We may ask for consent in specific situations, for example where we require your express permission to contact referees, process certain sensitive information, or keep you informed about future opportunities where consent is the most appropriate basis. Before we submit your CV or candidate profile to a specific client for a specific role, we will seek your authority to represent you for that opportunity.

6.5 Special category data

Where we process special category data, such as health information or equality information, we will only do so where we have a lawful basis and an additional condition under data protection law.

6.6 Criminal conviction data

We will only process criminal conviction data where it is lawful, necessary and relevant to the role.

7. Candidate authority to represent

We will not knowingly submit your CV or candidate profile to a client for a vacancy without your authority for that role.

Before submitting you to a client, we may ask you to confirm that:

  • you are interested in the role;
  • you authorise Environmental Recruitment Agency Limited, Enviro Recruit or Wind Talent to represent you for that vacancy;
  • you agree that we may share your CV, profile, contact details, relevant work history, qualifications, licence/card information and screening notes with the named client;
  • the information you have provided is accurate to the best of your knowledge.

8. Who we may share your data with

  • clients and prospective employers for recruitment purposes;
  • hiring managers, interviewers and decision-makers involved in the recruitment process;
  • job boards, recruitment platforms, applicant tracking systems and sourcing tools that support our recruitment activity;
  • background-checking, qualification-checking or reference-checking providers where relevant and agreed;
  • professional advisers, insurers, accountants or legal advisers;
  • regulators, courts, government authorities or law enforcement where required by law;
  • technology and IT service providers who support our systems.

We do not sell personal data. We will only share information that is necessary and relevant for the recruitment purpose.

9. Recruitment technology and AI-supported tools

We may use recruitment software, job boards, CV databases, sourcing platforms, matching tools or AI-supported tools to help identify, organise, search, shortlist or manage candidate information. We do not make final recruitment decisions solely by automated means. Human review is involved before candidates are recommended or submitted to clients.

10. International transfers

Some technology platforms or service providers may process data outside the UK. Where this happens, we will take steps to ensure appropriate safeguards are in place as required by data protection law.

11. How long we keep your data

We will keep candidate data only for as long as necessary for recruitment, legal, contractual, accounting or legitimate business purposes.

  • active candidate records may be kept while we are working with you;
  • candidate records may be kept for future suitable opportunities for up to 24 months from the last meaningful contact, unless you ask us to delete your details sooner;
  • unsuccessful application records may be kept for up to 24 months;
  • unresponsive sourced candidate records may normally be reviewed and deleted or archived within 6 to 12 months;
  • assessment data and technical screening records may normally be kept for up to 12 months unless they form part of a live recruitment process, placement record, dispute record or legal record;
  • placement, client submission, fee, contract and dispute-related records may be kept for up to 6 years;
  • accounting and invoice records may be kept for at least 6 years;
  • copies of qualifications, licences, trade cards or right-to-work related documents will not be kept longer than necessary for the recruitment purpose unless there is a lawful reason to retain them;
  • where possible, we may record that a document was checked rather than keeping a copy indefinitely;
  • we may keep limited suppression or do-not-contact records where you ask us not to contact you again.

12. How we protect your data

We take reasonable steps to protect candidate data against loss, misuse, unauthorised access, disclosure or alteration. This may include access controls, secure storage, password protection, limited access to candidate records, careful sharing procedures and internal data handling processes.

13. Your rights

You have rights under data protection law, including the right to be informed about how your data is used, access your personal data, ask us to correct inaccurate or incomplete data, ask us to delete your data in certain circumstances, ask us to restrict processing, object to processing based on legitimate interests, object to direct marketing, withdraw consent where we rely on consent, request data portability in certain circumstances and complain to the ICO.
